Booking Terms & Conditions
Please read the following terms and conditions carefully which, together with our Privacy Policy. All other documents and communications provided by Neverseen constitute the entire agreement between the parties and form a legally binding contract upon payment. Submission of payment to Neverseen signifies the acceptance of the Terms & Conditions of Sale.
Neverseen is a travel company trading as Neverseen Experiences LLC (EIN 92-2208659). Our registered office is at 6345 Balboa Blv, Suite 375, Encino, CA 91316. We are travel and lifestyle consultants for private, tailor-made experiential journeys across the globe. The terms "we", "us", "our", and “Neverseen" refer to Neverseen Experiences LLC. The term "you", “traveler” or “client” refers to the customer booking the travel package.
Before making any payment towards a journey or confirming your intent to participate in a journey with us, you must first ensure that you have asked any questions you may have and have read and understood these Terms and Conditions. PLEASE BE AWARE THAT THESE TERMS AND CONDITIONS CONTAIN WAIVERS OF LIABILITY AS WELL AS WAIVERS OF CLASS ACTION, VENUE SELECTION AND NOTICE CLAUSES. By making a payment and/or asking us to confirm your journey with us you are accepting all of the Terms and Conditions laid out below and acknowledging that you have read the Terms and Conditions of this legally binding agreement and agree to them. If you do not agree with any part of these Terms and Conditions, you must not make a booking with us or pay us in connection with our journeys.
If you are booking a travel package for another person you agree to inform that person(s) about the Terms & Conditions that apply to the booking you have made on their behalf, including all rules and restrictions applicable thereto and these Terms of Use. You also warrant that all information supplied by you or on your behalf, or by members of your party is true, current, complete and accurate.
If you are making a booking as a legal guardian of a participating minor, you are responsible for sharing these Terms and Conditions with any minors in your care and are financially responsible for the booking(s). We will not be liable for your failure to share these Terms and Conditions with all travelers accompanying you. If you are not the minor’s legal guardian or parent, the minor’s legal guardian or parent will need to separately read, acknowledge, and agree to these Terms and Conditions on behalf of the minor traveler(s) and complete a consent form authorizing the minor traveler to travel without their legal guardian or parent present.
AGENCY SCOPE & SUPPLIERS
Neverseen does not provide, own, manage, operate, supervise, or control the travel services and products that are or may be provided as part of your journey, such as flights, accommodations, packages, or travel insurance (the “Travel Products”). All Travel Products are contracted from separately owned, controlled, operated, or made available by independent third parties such as destination management companies, airlines, hotels, cruise lines, and tour operators (the “Suppliers”). Your trip constitutes a contract between yourself and the suppliers, even if purchased through Neverseen. Neverseen shall not be responsible for any act, omission, negligence, bankruptcy, insolvency, or default of any Supplier, company or person engaged in or responsible for any Travel Products or planning, or otherwise in connection therewith. All bookings are subject to the laws of the country in which such carriage or other facility or service is provided.
PRICING
Travel packages are quoted in US Dollars, per person and based on double occupancy, except where indicated otherwise. These quotes are valid for seven (7) days from the date the quote is sent. Please note the payment schedules and percentages outlined may vary from the standard booking procedures below according to the policies required by our suppliers. Any exceptions will be clearly detailed in the body of an email at the time of reservation.
Due to confidential agreements with Suppliers, Neverseen is under no obligation to provide a breakdown of the costs of any travel itinerary or services. Any modifications to a travel itinerary, including dates or number of people travelling, will require a revised proposal. Single travelers are often required to pay a single supplemental fee.
Trip Planning Fees
Neverseen reserves the right to charge a non-refundable planning fee before the planning of a trip begins. Depending on trip length or complexity, a non-refundable fee of $500-$2000 per week of travel is chargeable on bookings made for non-repeat travelers or travel agents. When the trip is confirmed, the fee will be applied towards the booking total. If the client decides not to confirm the fee is non-refundable.
STANDARD BOOKING PROCEDURES & PAYMENT SCHEDULE
At the time of confirming a booking, a non-refundable deposit is required, consisting of 30% of the total land-arrangement amount and 100% of any applicable flights or other non-refundable items. The deposit must be received within five days of receiving the invoice in order to secure reservations and guarantee the quoted rate. Flight prices are not guaranteed and may change until the tickets are issued. The remaining balance is due 90 days before the start date of the travel itinerary. If the booking is made within 90 days of the start date of the travel itinerary, a full 100% payment is due. If payment is not received by the due date, flights, hotels, transportation and all other reservations will be cancelled. Neverseen is not responsible for any penalties, fare increases or fees incurred due to late payment. ALL PAYMENTS ARE NON-REFUNDABLE.
Wire Payments
We only accept wire transfers for all payments received for your journey(s). Prior to wiring funds, please contact us by phone to confirm wire instructions due to an increase in wire-related fraud. We do not accept credit cards. All wire transfers are subject to the terms and conditions of your banking institution. You shall be responsible and solely liable for any and all fees assessed by your banking institution for all wire transfers to Neverseen.
PACKAGE EXCLUSIONS
Unless specifically noted, travel packages do not include; (i) travel insurance (ii) international airfare (iii) domestic or internal airfare unless otherwise noted (iv) costs associated with obtaining passports, entry visas or vaccinations (v) reciprocity and other border fees (vi) airport departure taxes (vii) all baggage charges (viii) gratuities (ix) meals other than those specified in the itinerary (x) beverages other than those noted in inclusions above or specified in the itinerary (xi) any meals for your guide if you invite him/her to dine with you (xii) activities, hotels and transportation not included in the itinerary (xiii) personal expenses such as laundry, room service and mini-bar consumptions at hotels (xiv) internet access (xv) additional activities requested during travel (xvi) changes in government-imposed taxes and fees post-booking.
TRAVEL INSURANCE
Travel protection insurance is not included in your booking with us. It is the traveler’s responsibility to protect their purchases. For this reason, travel insurance and additional “cancel for any reason” coverage insurance is strongly recommended. Such plan should cover Trip Cancellation or Interruption, Medical Expenses, Emergency Evacuation and Repatriation, and Baggage. Travel insurance protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the journey). It also helps with reimbursement for medical emergency costs (including very costly evacuation costs), missed connections and baggage loss. Travel protection insurance plans including “cancel for any reason” coverage must be purchased in conjunction with your booking. Neverseen is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. Neverseen cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection insurance, call your insurance broker.
Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. Neverseen cannot be held responsible for denied entry if a traveler is unable to provide details to authorities of insurance of denial of entry for any reason. IF YOU CHOOSE TO TRAVEL WITHOUT ADEQUATE COVERAGE, WE WILL NOT BE LIABLE FOR ANY OF YOUR LOSSES HOWEVER ARISING, FOR WHICH TRIP PROTECTION INSURANCE COVERAGE WOULD OTHERWISE HAVE BEEN AVAILABLE.
AIRFARE
International airfare (to the travel itinerary starting point and from the ending point) is not included in the travel package. Some travel itineraries require domestic flights as specified in the itinerary. This airfare is typically not included and must be purchased from Neverseen in addition to the travel itinerary unless otherwise specified. In the instance where flights proposed in the itinerary are no longer available, Neverseen reserves the right to substitute and confirm air reservations on a suitable alternative. All domestic air is 100% non-refundable at time of final payment. All international and domestic airfare quotes are subject to change in fare and availability until final payment and passport copies of each traveler have been received by Neverseen.
All air carriers are independent contractors and are not owned, managed, controlled or operated by Neverseen. Your airline ticket constitutes a contract between yourself and the airlines, even if purchased through Neverseen. Please check with your international carrier for other baggage restrictions and fees applicable to your domestic and international flights. Unless specifically stated in your itinerary, rates do not include Airline baggage or seat assignment fees or other ancillary fees related to your airborne journey. Neverseen is not liable for, and does not assume responsibility or accept claims with regard to: seat assignments, name changes, schedule changes, flight changes and/or cancellations. Should you change or cancel your air transportation arrangements before or after your travel begins, all airline change and cancellation fees will apply.
Baggage and personal effects are at the owner’s risk throughout the travel itinerary, and Neverseen assumes no liability for lost or damaged baggage. Therefore, you are urged to purchase travel insurance that includes provisions for your baggage. Please check with your international carrier for other baggage restrictions and fees applicable to your international flight.
OPTIONAL ACTIVITIES
During a booked Neverseen itinerary, there may be opportunities to participate in activities or local events, which are not included in Neverseen’s travel package. Neverseen makes no representations about the safety or quality of these activities or the standard of the independent operator running it. You accept that any additional assistance given by your group leader, host, guide or local representative in arranging optional activities does not render Neverseen liable for them in any way. The contract for the provision of that activity will be between you and activity provider, Neverseen will have no liability for your participation in such activities and you will be bound by the terms and conditions of the independent operator.
VISAS & DOCUMENTATION
It is the customer’s responsibility to verify current entry requirements and obtain/pay for the necessary travel documentation (visas, reciprocity fees, affidavits, immunisations, etc.) based on the country of origin, destination and any countries in which a stop is scheduled. For up-to-date detailed information on travel documents and visas, entry/exit taxes and further information on entry and exit requirements please check with your local consular services. By offering travel packages in particular international destinations, Neverseen does not represent or warrant that travel to such areas is advisable or without risk. It is your responsibility to stay informed about the areas to which you will be travelling, including any travel advisories and warnings issued by your country’s government. You are responsible for protecting your own well-being and personal property before, during, and after your booked travel itinerary. Neverseen will not be liable for damages or losses that result from travel to such destinations. It is the customer’s responsibility to carry and verify that a passport is valid at the time of departure, remains valid for a minimum of 6 months beyond the return travel date, and contains sufficient blank pages to attach any required visas for their travel. Some countries may require that children under 18 years of age must travel with the consent of both parents. Please verify the most current documentation and entry requirements with the country’s consulate, an immigration office or at travel.state.gov. No refund will be issued for losses incurred as a result of failure to obtain or provide required valid documentation.
ITINERARY CHANGES
No Guarantees
Neverseen makes no promises or guarantees that any celebrity participant will attend the travel journey in part, or in whole, on any particular itinerary. While we will make every available effort to confirm the celebrity participant, their availability and appearance is ultimately outside of our control. In the event a celebrity does not attend or participate in your travel journey, we shall not be liable for any refund to you or anyone travelling with you.
Itinerary Changes by Neverseen
Neverseen reserves the right, if necessary, to substitute other similar Travel Products (including hotels) for any Travel Products listed on your itinerary. Such substitutions may be made at any time and without prior notice. Such substitutions are at Neverseen’s sole discretion and no refunds will be offered for changes with any Travel Products. Likewise, Neverseen shall not be responsible for any incidental expenses incurred as a result of any changes or cancellations.
Itinerary Changes by the Traveler
Neverseen will always try their best to accommodate any client requests. Any changes you may make after the initial deposit may incur change fees. Changes in travel arrangements that result in additional monies owed due to price differences, fuel surcharges, ticket re-issuance fees, etc. are due and payable directly to Neverseen at the time of change.
SCHEDULED GROUP DEPARTURES
Participant Minimums
Neverseen will occasionally organize group departures requiring public buy-in. Pricing for these trips is based on the number of participants. Neverseen makes every effort to ensure that the journeys meet the minimum participant requirements. However, if the journey drops below the minimum number of participants, cancellation of the journey may occur at the sole discretion of Neverseen. In such a case, participants will be advised of the inability to meet the minimum number of participants at least 30 days prior to final payment. Neverseen reserves the right to change the departure date and may offer alternative journey dates or other travel arrangements; some even to accommodate a smaller group of participants. You may choose to accept these arrangements and retain your booking with the new dates or cancel your booking. If you choose to retain your booking, your deposit, and any payments made will be credited toward the new travel dates. Since all payments made to Neverseen are non-refundable, we work diligently to meet the minimum participant requirements. On the rare occasion we are unable to meet the minimum participant requirements to conduct the journey and you are unable to participate in a different journey with us, Neverseen will provide you with a refund for all payments made to Neverseen for the journey less any non-recoverable expenses and non-recoverable deposits paid to Suppliers.
Additional Expenses Incurred
Should your journey be postponed or cancelled by us, Neverseen will not be liable for any additional costs incurred outside of the journey prices such as visa, passport fees, travel insurance, non-refundable flights, or any other purchases made by any participant in anticipation of the booked journey. For this reason, we highly recommend booking changeable flight fares and purchasing travel protection insurance. We also recommend - and sometimes require - that travelers purchase travel insurance that covers cancellations or changes in plans to mitigate potential losses.
CANCELLATION
Cancellation by the Traveler
Any cancellation by the traveler must be requested in writing and must be acknowledged by Neverseen in writing. The cancellation will become effective on the date of acknowledgement by Neverseen. The following standard charges apply from the date before departure within which written cancellation is received by us:
Upon booking: 30% of invoice total plus cost of non-refundable items such as airfare or private charters.
90 to 0 days: 100% of invoice total.
Should you change or cancel your air transportation arrangements before or after your travel begins, all airline change and cancellation fees will apply. A re-booking admin fee of $250 per person may also be applied by Neverseen. Likewise, as Neverseens’ prices are based on contract rates, there will not be any refund for any unused portion of a travel booking. If you cancel while your journey is in progress, there will be no refund for the unused portion.
Postponement or Cancellation for Other Reasons
Neverseen reserves the right to cancel or postpone any journey at any time prior to departure due to any force majeure event or significant threat of a force majeure event (as defined in the section titled “Force Majeure”) occurring or set to occur in the location of the journey, in any arriving, departing, or connecting location, or locally as it relates to Neverseen and Travel Agency’s location and ability to perform. Should Neverseen decide to postpone or cancel a journey for these reasons, you will be given the option to retain your booking with new travel dates or receive a refund for all payments made less any non-recoverable expenses and non-recoverable deposits paid to Suppliers. Neverseen is not responsible for any incidental expenses that you may have incurred as a result of your booking, including, but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.
Force Majeure
Neverseen assumes no liability for any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, or any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics (including, without limitation, COVID-19), or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Neverseen that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions (“force majeure”). In the circumstances amounting to force majeure, we will not be required to refund any money to you, although if (and only if) we can recover any monies from our Suppliers (it being under no obligation to do so), we will refund these to you without any charge by Neverseen.
Credits
In certain circumstances, at our discretion, we may offer a credit for future travel with us. All credits are subject to the terms and conditions of our local suppliers and partners. Our ability to offer such credits is contingent upon their policies and be in alignment with their guidelines in these exceptional instances. Should such a credit be issued, it must be utilized within one year from the date of issuance. This provision is designed to accommodate our travelers in exceptional situations, allowing them the flexibility to reschedule their journey within a designated timeframe. Credits not redeemed within this period will be forfeited.
MEDICAL TREATMENT
If medical treatment is necessary as a result of my participation in the journey, travel to and from the journey, or any events incidental to this journey, traveler agrees to be fully financially responsible for any costs incurred as a result of such treatment for herself and any minor travelling with her and to assume full responsibility for any treatment or lack of adequate treatment received.
PERSONAL RESPONSIBILITY
Each traveler is expected to act responsibly and adhere to all behaviour guidelines established by any partner supplier or accommodation. You shall hereby defend, indemnify, and hold Neverseen harmless against any, and all third-party claims arising out of any conduct or omission in breach of these terms and conditions or that otherwise creates liability for Neverseen.
Some of Neverseen trips are intentionally designed to take clients “off the beaten path” to places where facilities, infrastructure, safety and other standards may not be sophisticated and may be different from those in a traveler’s home country. Trips involve physical activity that can be demanding, depending on the condition of the traveler, and the risk of serious personal injury, including permanent disability and death from accident, illness or the actions or negligence of other persons. Medical facilities and services may not be easily accessible and may not be sophisticated.
The traveler acknowledges that he/she is aware that travel such as the journey he/she is undertaking involves potentially dangerous activities, some in remote areas of the world, with a risk of illness, injury or death which may be caused by forces of nature, illness, or by the willful or criminal conduct of third parties or by terrorism. The participant further acknowledges that weather conditions may be severe and/or adverse, and that medical services or facilities may not be readily available or accessible or with quality standards which exist in countries such as the United States or Europe.
COMPLAINTS
We will always endeavour to resolve any complaints on the spot. Any complaint whilst on holiday must be voiced to the person in charge of providing the service, and to any local representative of Neverseen.
CUSTOMER IDENTIFICATION & PROOF OF CITIZENSHIP
The Transportation Security Administration (TSA) requires all airline passengers traveling on and after November 1, 2010 to provide the following Secure Flight Passenger Data (SFPD) regardless of when the reservation was booked:

Names provided to Neverseen for customers must be an exact match to the passport that will be used during travel. The customer is responsible for all fees and expenses that may be incurred due to an incorrect name, or to the denial of travel due to an incorrect name. Updated information regarding security measures and requirements for air travel are available at www.tsa.gov. It is highly recommended for the customer to check this website for possible changes due to security measures and air travel for their scheduled destination(s).
APPLICABLE LAW AND VENUE
The State of California law governs these Terms and Conditions to the fullest extent allowable. Any disputes in connection with a Neverseen travel package or these Terms and Conditions will be initiated in the Superior Courts of the State of California where exclusive jurisdiction and venue reside. If a court or any other appropriate authority finds any portion of this document to be invalid, the remainder will remain in full force and effect. All client claims must be submitted in writing and received by Neverseen no later than thirty (30) days after the completion the booked travel itinerary. Client claims not submitted and received within this time shall be deemed waived and barred.
JURY WAIVER, LIMITED DAMAGES, STATUTE OF LIMITATIONS & NOTICE OF CLAIM
You agree that you will only bring claims against Neverseen in your individual capacity and not as a plaintiff or class member in any purported class action or representative proceeding. Neverseen shall not, in any case, be liable for other than compensatory damages, and any payment made to us shall mean that you agree to these Terms and Conditions of sale and expressly waive any right to punitive damages. YOU UNDERSTAND AND AGREE THAT NO CLAIMS WILL BE CONSIDERED AND THAT YOU WILL NOT BRING SUIT AGAINST NEVERSEEN UNLESS YOU HAVE FIRST PROVIDE A TYPEWRITTEN NOTICE OF CLAIM TO NEVERSEEN WITHIN 30 DAYS AFTER THE JOURNEY OR CANCELLATION OF THE JOURNEY, FURTHER PROVIDED THAT YOU AGREE TO FILE SUIT WITHIN ONE (1) YEAR OF THE INCIDENT AND YOU ACKNOWLEDGE THAT THIS EXPRESSLY LIMITS THE APPLICABLE STATUTE OF LIMITATIONS TO ONE (1) YEAR.
UPDATING BOOKING TERMS & CONDITIONS
Neverseen reserves the right to update and/or alter these Booking Terms & Conditions at anytime at Neverseen sole discretion without notice. It is the client’s responsibility to be familiar with them. The latest Booking Terms & Conditions can always be found on the Neverseen website www.neverseen.travel and will supersede any previous versions.
